1. Scope and language of this agreement
These Terms of Service govern your use of the Space Racer LLC website and any purchase made through it. Where any translation exists for convenience, the English-language version prevails. By placing an order or otherwise using our site, you confirm that you accept these terms in full.
2. Products covered
Space Racer LLC supplies wood acoustic panels (which mitigate, but do not guarantee, specific RT60 or STC values), Flex Marble wall panels, SPC Marble wall panels, and PVC Marble wall panels. All panels are decorative finishes designed to alter the look and — in the case of the wood acoustic range — the perceived acoustic behavior of an interior. Colors, tones, and surface textures vary between production runs, and samples are indicative only.
3. Order acceptance
A binding contract is formed on completion of checkout via our Stripe Connect payment link, or — while Stripe Connect owner onboarding is pending — on our written confirmation of an order placed by email to the address shown on our contact page. We reserve the right to refuse or decline any order, including where stock is unavailable, where a payment cannot be verified, where we suspect fraud, or where jurisdictional restrictions prevent lawful shipment. Acceptance of an order is at our sole discretion unless and until written confirmation has been issued.
4. Payment
The primary payment path is Stripe Connect checkout, accessed from the featured product page on our site. Prices are stated in US Dollars and are inclusive of any applicable discounts; taxes, import duties, and local fees are calculated by destination and are the responsibility of the buyer. Accepted methods are those supported by Stripe at the time of purchase. While Stripe Connect owner onboarding is pending, orders may also be placed by email using the address shown on our contact page; in that case we will agree payment terms in writing before shipment.
5. Shipping and returns
Orders ship from New York or Philadelphia, as applicable to the product and destination. A $25 shipping fee applies to sample kits. Delivery windows are estimates and begin from the date of payment clearance or written order acceptance, not from the date of order submission. Risk of loss passes on delivery to the address supplied by the buyer. Returned panels must be unused, in their original packaging, and notified to us within the stated returns window; the buyer is responsible for return carriage costs unless the return arises from our error. We do not accept returns on custom-finished or cut-to-size panels.
6. Installation disclaimer
All panels supplied by Space Racer LLC are decorative. They are not load-bearing, structural, or certified as substitutes for proper moisture-barrier or vapor-barrier work. Acoustic panels mitigate reverberation but do not guarantee any specific RT60 or STC value, and published data sheets should be read as indicative. The installer or end user is responsible for substrate preparation, the selection of an appropriate adhesive, and assessing wet-area suitability. SPC Marble and PVC Marble are not recommended for submerged or constantly wet environments, such as shower walls or tank linings. Fire performance should be read from the manufacturer's data sheet and not assumed.
7. Liability limitations
To the fullest extent permitted by law, we exclude any liability for consequential, indirect, incidental, special, or punitive damages, including lost profits, lost revenue, or business interruption, arising out of or in connection with our products or site. Where liability cannot lawfully be excluded, our aggregate liability is limited to the amount you have paid us for the affected products. Nothing in these terms is intended to exclude or limit any statutory rights you may have as a consumer under the law of your place of residence.
8. Governing law and jurisdiction
These terms are governed by the laws of the State of Florida, United States of America, without regard to conflict-of-laws principles. The state and federal courts located in Hillsborough County, Florida have exclusive jurisdiction over any dispute arising from or related to these terms or your use of our site, save where a consumer-statute in your jurisdiction provides otherwise. If any provision of these terms is held unenforceable, the remaining provisions continue in full force. Our failure to enforce any right is not a waiver of that right. These terms, together with our Privacy Policy, constitute the entire agreement between you and Space Racer LLC in relation to your use of the site and supersede any prior representation.
